Terms of Use

These Terms of Use govern your access to and use of www.aldenpierce.com (the "Website"), operated by Alden Pierce ("we", "us", "the Owner"). By accessing the Website you agree to these Terms. If you do not agree, do not use the Website.

1. Ownership of content

All photographs, videos, moving images, illustrations, texts, graphics, layouts, logos and other materials on the Website (the "Content") are original works owned by Alden Pierce or used under licence, and are protected by copyright and related rights under the Law on Intellectual Property of Vietnam, the Berne Convention for the Protection of Literary and Artistic Works, the U.S. Copyright Act (17 U.S.C.) including the Digital Millennium Copyright Act, and other applicable international treaties and national laws.

Registration. Copyright registration application filed — pending official review. Registration status does not affect the existence of copyright, which arises automatically upon creation of each work.

2. Limited permission to view

You may view the Content in a web browser for personal, non-commercial purposes only. No other right or licence is granted, expressly or by implication.

3. Prohibited uses

Without our prior written licence you must not: (a) copy, download, screen-record, scrape, save or store any Content, except temporary browser caching; (b) re-upload, re-post, share, publish, broadcast or distribute any Content on any website, social network, video platform, marketplace or app; (c) edit, crop, re-colour, re-edit, add music or text to, or create derivative works from the Content; (d) remove, obscure or alter any watermark, Work ID, copyright notice or embedded copyright metadata (removal of copyright-management information is separately prohibited under 17 U.S.C. § 1202 and Vietnamese law); (e) use the Content to train, fine-tune or prompt artificial-intelligence or machine-learning systems, or to create datasets; (f) use the Content for advertising, merchandise, NFTs or any commercial purpose; (g) frame or hot-link the Content from another website; (h) claim authorship of any Content.

4. Licensing

Licences are granted only in writing and only for the scope, territory, duration and fee stated in that written licence. To request a licence, use the licensing form or the "Request licensing" button on each work.

5. Enforcement

We actively monitor the use of our works. Each work carries a unique Work ID, a visible watermark, embedded copyright metadata and a recorded first-publication date and digital fingerprint (SHA-256), which we use as evidence. Unauthorized use will result in takedown notices to hosting providers and platforms, a demand for licence fees and damages, and where appropriate civil, administrative or criminal proceedings. We reserve all rights and remedies available under applicable law, including statutory damages where available.

6. Disclaimer and limitation of liability

The Website is provided "as is". To the maximum extent permitted by law, we are not liable for indirect or consequential damages arising from use of the Website.

7. Governing law and jurisdiction

These Terms are governed by the laws of the Socialist Republic of Vietnam, without prejudice to the mandatory protection afforded to copyright owners in the country where infringement occurs. We may bring proceedings in any court of competent jurisdiction, including the courts of the place where the infringement occurred.

8. Changes

We may update these Terms at any time. The version published on this page applies from its date of publication.
